ARTICLE 1 : SCOPE
The below sales conditions have to be shown to any customer who intends to put in an order. If you put in an order you must adhere to these sales conditions.
The present purchase order is therefore firm and definite.
You have declared that you have read the terms and conditions before placing your order. The validation of your order therefore means you have accepted these sales conditions.
ARTICLE 2 : DELIVERY TIME
The seller undertakes to respect a 3 week delivery time once the order has been validated.
ARTICLE 3 : RATES
Photo BRETON reserves the right to change its prices at any time, but the product will be charged on the basis of the rates in force at the time of the order.
ARTICLE 4 : DELIVERY
It is agreed that the transfer of an ordered product is effective as soon as the product leaves the shop. The buyer therefore agrees to accept all the risks, especially those linked to transport, (unless the transport is taken care of by the seller). If the buyer doesn’t give any specific instructions about the transport, the seller reserves the right to ship the products the way he feeds is best, which doesn’t mean he can be held for responsible in the event of a problem. If it is not possible to deliver the product to the premises of the buyer (because there is no access or because letter box is too small) the seller will not be held responsible.
ARTICLE 5 : PAYMENT
Full payement will be taken at the time of the order.
The money received will by not considered as a deposit.
Photo BRETON reserves its right not to action an order made by a buyer with whom there is (or has been) a payment dispute.
ARTICLE 6 : CLAIM
The buyer must check the products when they are delivered. If the buyer intends to express reservations about the state of the delivered products, then he should refuse the delivery or send the products back immediately.
ARTICLE 7 : GUARANTEE
According to the articles 1641 (and following) of the Civil Code, the seller guarantees the buyer for all consequences linked to defects (conspicuous or hidden) that the sold products might reveal, if those defects are notified as soon as they are discovered. Any functional or aesthetic deterioration linked to defects (conspicuous or hidden) that would appear with use and of which the seller didn’t know of are covered by the guarantee, without restrictions or limitations. However, guarantee does not apply to deteriorations linked to usage or to causes extraneous to the intrinsic properties of the products, such as deteriorations resulting of an abnormal use (humidity, excessive heating, etc.) or deteriorations resulting of the buyer’s acts (transport, handling, hanging). In any case, the buyer will have to prove the existence of the hidden defect on the delivery day.
ARTICLE 8 : RETURN TO SENDER
According to the article L 121-16 of the Consumers Code, the buyer has a 7 day cooling-off period to return the order at his own costs starting from the delivery date.
By exercising his right to retract, the buyer will be paid back in cash.
